Terms and conditions
1. ORGANIZING COMPANY AND PURPOSE
Club Atlético de Madrid S.A.D, (hereafter Club Atlético de Madrid), with Tax Code A-80373764 and registered office in Paseo Virgen del Puerto 67, 28005 of Madrid, recorded in the Madrid Trade Register, is organizing a promotional action on Facebook, Twitter and Instagram (hereafter the Promotion), which has the purpose of promoting Club Atlético de Madrid.
The Promotion consists of awarding the Prize of 2 VIP tickets for the match Atlético de Madrid vs FC Barcelona taking place on Nov. 24th, 2018 the plane or train ticket for 2 people from their town of residency to Madrid and accommodation in a double room at a 3 stars hotel in Madrid for one night from Nov. 24th to Nov. 25t to one winner, to be decided by Club Atlético de Madrid.
2. PROMOTIONAL PERIOD
The period of participation shall start at 10 am CET of November 16th, 2018 and run until 8 pm CET of November 19th, 2018. Outside this period, any answers received shall not be taken into account. Participants may take part as many times as they wish throughout the Promotional period.
3. PROMOTIONAL DYNAMIC
The winner shall be chosen by Club Atlético de Madrid from among the participants who publish a picture cheering the team with the hashtags #AtléticosPorElMundo, #AtléticosDuMonde or #AtléticosAroundTheWorld on Facebook, Instagram or Twitter and tagging the person they would like to share the Prize with and tagging Plus500 (www.facebook.com/Plus500, www.twitter.com/plus500 y www.instagram.com/plus500).
Said post shall remain active during the participation period established in point 2 of these legal rules.
On November 16th, 2018, Club Atlético de Madrid shall announce the launch of the Promotion on the official Facebook, Instagram and Twitter account of Club Atlético de Madrid: www.facebook.com/atleticodemadrid, www.twitter.com/Atleti, www.twitter.com/atletiFR, www.twitter.com/atletienglish and www.instagram.com/atleticodemadrid.
From that moment on, it shall be open to participation, provided participants fully comply with the described requirements, until the Promotion’s end.
The Judging Panel, which shall be comprised of members of Club Atlético de Madrid, shall choose the Winner and two reserve runners-up who have taken part in the Promotion, judging their answers for their originality, emotion and alignment with the club´s values.
Club Atlético de Madrid shall contact the winner through their Facebook, Twitter or Instagram account. Should the selected person not reply within the next 2 hours of the first notification, the first reserve runner-up shall be contacted and, if not successful, the second runner-up and so on.
Club Atlético de Madrid shall notify the winner of the steps to be taken to enjoy the Prize. Should no Participant meet the requirements, or should they not accept or not collect the Prize as per the provisions of these rules, the Prize shall not be awarded. Should none of the Participants meet the requirements for carrying out the promotional dynamic, or in the event of non-acceptance or non-collection of the Prize as established in these rules, the promotional dynamic shall be declared void.
4. PARTICIPATION REQUIREMENTS
Participation in the Promotion is free of charge and any person taking part through Facebook, Instagram or Twitter (hereafter 'the Participants') may be the beneficiary provided they follow the promotional dynamic and meet the terms of these Rules.
The Participants understand and expressly accept that taking part in this promotion implies that their name and their image shall be published, viewed and shared by the rest of online users on the promotion and other mediums of Club Atlético de Madrid, without this violating or affecting their privacy in any way whatsoever.
Participation in this promotion entails the express acceptance of the Facebook, Instagram or Twitter Terms and Conditions of Use.
Should the Participant be a minor, it shall be an indispensable condition to accredit the consent of their parents, guardians or legal representatives, both for participating and, if applicable, for receiving the Prize specified in these rules.
Club Atlético de Madrid reserves the right to automatically expel from the action any Participant who is deemed to have made improper use or to have abused this promotion, and their participation shall be cancelled. Understood by improper use is the breach of any condition included in these Rules and/or of the Facebook, Twitter or Instagram Terms and Conditions as well as carrying out any interventions of an offensive, violent, sexist, racist, sexual or pornographic nature or that may violate the fundamental rights of individuals.
The following are excluded from this Promotion:
- The employees of Club Atlético de Madrid. The employees of the companies, advertising agencies or promotional agencies involved in this promotion.
- The immediate relatives (to the second degree of consanguinity) of the persons included in the points immediately above.
- Minors who do not accredit the authorization of their parents, guardians or legal representatives.
- Any persons who have participated in a fraudulent or false manner, with profiles that bear no relation to reality or that may belong to automated internet systems, and acquisitions listed as non-secure and made illegitimately. The winner may waive their right to the Prize but may in no case exchange it for another Prize or for its amount in cash.
5. PRIZES FOR PARTICIPATING IN THE COMPETITION
The Prize shall consist of 2 VIP tickets for the match Atlético de Madrid- FC Barcelona taking place on Nov. 24th, 2018, the plane or train ticket for 2 people from their town of residency to Madrid and accommodation in a double room at a 3 stars hotel in Madrid for one night from Nov. 24th to Nov. 25th (hereafter the “Prize”).
To enjoy the Prize, the Winner shall bear any additional costs in which they have to incur for any reason, since the Prize is limited to the description in the above paragraph.
The Prize does not include anything not mentioned in the above point. Club Atlético de Madrid reserves the right to change the Prize for others of equal or higher promotional value at its discretion.
Taxation of the Prize shall comply with any regulations that may be applicable. The winners may waive their right to the Prize but may in no case exchange it for a different one or for its amount in cash, and such waiver shall not give them the right to any reparation or compensation whatsoever.
The Prize is personal and non-transferable and its sale or commercialization is prohibited. The Prize winner and any possible beneficiaries expressly assume any special risks and situations that may be derived from the use or enjoyment of the Prize obtained through the Promotion.
6. PUBLICATION OF THE WINNER’S IDENTITY
The winner accepts that their name shall be published in the official Club Atlético de Madrid means. They also accept the use of their image and that of their escort in video or photography for the purposes of advertising the experience resulting from the Prize.
The winner expressly authorizes Club Atlético de Madrid, without territorial limitation, from the time of acceptance of these rules, to capture, disseminate and use through any written, spoken and filmed medium, in any form, on any means and through any means, their name, image and voice throughout the period of protection granted by the legislation and for all countries in the world.
7. DATA PROTECTION
Pursuant to the provisions of Organic Law 15/1999 of 13 December on Personal Data Protection (LOPD) and of EU Regulation 2016/679, Club Atlético de Madrid informs that any personal data provided to Club Atlético de Madrid during the promotion may be incorporated into the internal activity file or register owned by Club Atlético de Madrid and shall be used for managing and carrying out the Promotion (including the publication of the winner in the different official means of Club Atlético de Madrid).
Each Participant may exercise their rights to access, rectification, cancellation and opposition in regard to their personal data by requesting it in writing, together with a copy of their ID and indicating the right they wish to exercise, at the following email address: [email protected] or at the address of 'Paseo Virgen del Puerto 67, 28005 Madrid', with the following indication “LOPD. Promotion: “PLUS500 WITH THE ATLÉTICOS POR EL MUNDO”.
8. LEGISLATION AND JURISDICTION
These Rules are governed by Spanish Law and the Participants, expressly waiving any other jurisdiction, submit to the Courts and Tribunals of the city of Madrid for any controversy that may arise.
